Decision:

Following race 5 an information was filed by the informant, Mr C Lammas, rider of the fourth horse CLAIRE ROSE. This came pursuant to Rule 876(1) and Mr Lammas alleged that RARE FOX placed third by the Judge interfered with the chances of his mount

DECISION & REASON:

Following race 5 an information was filed by the informant, Mr C Lammas, rider of the fourth horse CLAIRE ROSE. This came pursuant to Rule 876(1) and Mr Lammas alleged that RARE FOX placed third by the Judge interfered with the chances of his mount CLAIRE ROSE in the final straight. The official margin between third and fourth was a head. All connections were informed of the protest.

Present at the inquiry were:

RARE FOX ? trainer and owner, Mr M Cleland, rider L Satherley.

CLAIRE ROSE ? Mr H McQuade, trainer and part-owner K McQuade, rider C Lammas

The informant, Mr C Lammas, demonstrated the video films and showed where he got pushed out two horse widths by RARE FOX in the run to the line. He said although he did not stop riding he believed the bump cost him at least a head.

Mr McQuade said CLAIRE ROSE was bumped out two horse widths which he also believed cost his horse at least the head margin. Mrs McQuade said the bump certainly caused CLAIRE ROSE to lose momentum.

Mrs Satherley, rider of RARE FOX, said that Mr Lammas did not stop riding and that the second horse rolled in which caused her to pull off its heels and move out slightly. She also said there was no contact between the two horses.

Mr M Cleland, trainer of RARE FOX, said Mr Lammas had not stopped riding and he did not consider his horse had moved out two horse widths.

Mr W Robinson, Assistant Stipendiary Steward, said that in his opinion RARE FOX only moved out half a horse width and both horses had a clear run to the line. He believed the Judge's placings should stand.

The Committee carefully considered all evidence and repeated viewing the video films. While we agree there was some outward movement from RARE FOX we believe this was only approximately a half horse width. From here both horses had a clear run to the line confirming our opinion that the chances of CLAIRE ROSE finishing in a better place were not affected. Accordingly the Judge's placings shall stand.
