FACTS:
--Following the running of Race 3, Charity Hospital Trustees Mobile Pace, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Junior Driver, Mr B M Thomas, alleging a breach of Rule 864 (2) (e) in that Mr Thomas, as the driver of THAT’S ALL RIGHT in the race, “failed to activate the hopple shorteners during the race”.

Mr Thomas had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. Mr Thomas had also signed an endorsement on the information form stating “being a junior driver has pleaded guilty and does not want to be represented”. Mr Escott informed the Committee that Mr Thomas, prior to signing the information, had received advice from Mr D J Dunn, Licensed Junior Driver.

Rule 864 provides as follows:
--(2) Every horseman, owner, trainer and assistant thereof of a horse shall with regard to that horse ensure that:-
--(e) that all steps are taken to activate gear, appliances or devices which requires activation.

SUBMISSION(S):
--Mr Escott stated that Mr Thomas was having his first drive in a totalisator race and, simply, forgot to activate the hopple shorteners on the horse. The horse completed the race with the hopple shorteners still in place. Mr Escott said that the horse finished in 3rd placing, the margins being ½ length and a nose. In response to a question from the Committee, Mr Escott said that it was very likely that the horse’s performance was affected by the hopple shorteners not being activated.

Mr Escott showed a video replay of the final 300-400 metres of the race.

DECISION:
--The charge was found proved.

SUBMISSION(S) ON PENALTY:
--Mr Escott submitted that a fine of $200 was appropriate. He referred to Mr Thomas’ admission of the breach but pointed out that the performance of the horse was most likely affected by Mr Thomas’ omission.

REASONS:
--The Committee took into account Mr Thomas’ inexperience and his admission of the breach. The breach was most likely a consequence of Mr Thomas’ inexperience and, no doubt, Mr Thomas will be better for the experience and the lesson learned. However, the Committee could not overlook the fact that the horse’s performance was most likely affected and, therefore, the result of the race could also have been affected, thereby affecting the betting public.

The Committee is aware that hopple shorteners are controlled by the driver so that he may shorten the early length of a horse’s stride to help eliminate the possibility of the horse going into a gallop. If the hopple shorteners are not released after the start, the horse is forced to run the whole race with the length of its stride being restricted.

The Committee regarded the breach as being in the higher range as far as breaches of the Rule are concerned.

PENALTY:
--Mr Thomas was fined the sum of $200.
