DECISION AND REASONS:

Following the running of Race 7, Russalie Farm (PBD) Mobile Pace, an information instigating a protest was lodged by Stipendiary Steward, Mrs K R Williams, against SMOKE N MIRRORS (M P Jones), placed 2nd equal by the judge, on the grounds of interference to FOREAL (A M Butt), placed 2nd equal by the judge, in the home straight.

Mr M P Jones represented the connections of SMOKE N MIRRORS at the hearing of the protest. Trainer, Mr K T Odgers, was also present.

Mrs Williams showed video replays of the final 300 metres of the Race. She pointed out SMOKE N MIRRORS in the trail behind the leader IT’S ELLA approaching the home turn. Mrs Williams said that Mr Jones had the option of taking the passing lane. However, his horse commenced to hang coming into the straight. FOREAL was on the back of SMOKE N MIRRORS. Mr Butt looked for a run outside SMOKE N MIRRORS but was held up in attempting to do so and was checked for several strides before running on the dead heat for 2nd placing. The Stipendiary Stewards were seeking relegation of SMOKE N MIRRORS to 3rd placing.

Mr N M Ydgren, Stipendiary Steward, with reference to the video replays, showed Mr Jones in the trail. Mr Butt moved into the gap where Mr Jones had been. Mr Jones was unable to steer his horse down into the passing lane and Mr Butt had nowhere to go as a consequence when SMOKE N MIRRORS began to shift ground outwards.

Mrs Williams alleged that SMOKE N MIRRORS had run out on two occasions in the straight and denied Mr Butt a clear run on FOREAL. Mr Jones should have remained inside the wheel of ITS ELLA, she said, but his horse hung so badly that it impeded the progress and chances of FOREAL.

Mr Butt stated that the video evidence was clear. The indication was that Mr Jones was going for the passing lane so he, Mr Butt, went "up the middle". It could be clearly seen that SMOME N MIRRORS had "run out on two or three occasions" and, on the last such occasion, it got very tight and FOREAL "all but galloped". Mr Butt said that Mr Jones had tried to keep his horse off him but it had continued to run out and checked the momentum of FOREAL two or three times.

Mr Jones stated that at no stage did Mr Butt have a full gap. He said that he attempted to go inside the leader, IT’S ELLA, but only got to its wheel and then stayed there until the last 50 metres. Mr Butt disputed that and alleged that there was a clear gap (a cart and a half, he submitted) between SMOKE N MIRRORS and TIME TO FLY on its outside when Mr Jones attempted to go on the inside of the leader. He demonstrated this on the video which supported his contention.

The Committee was satisfied that this was a clear case of interference by SMOKE N MIRRORS to FOREAL in that it took the rightful line of running of FOREAL – in other words, FOREAL was entitled to the run but it had been denied that through the outward movement, on several occasions, of SMOKE N MIRRORS during the run home as a result of which the progress of FOREAL and the chances of its finishing in a higher placing have been affected – it has been deprived of outright 2nd placing as a result of the interference received.

The protest was upheld and FOREAL was promoted to outright 2nd placing and SMOKE N MIRRORS relegated from 2nd equal to 3rd placing.
