DECISION AND REASONS:
--Following the running of Race 7, Mark Cousins Memorial Discretionary Handicap Trot, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Junior Horseman, Miss A D Edmonds, alleging that Miss Edmonds, as the driver of ELLA POWELL in the Race, "used the whip excessively in the run home".
----Miss Edmonds was present at the hearing of the information and admitted the breach. She was assisted at the hearing by Licensed Open Horseman, Mr S R McNally. The breach was found proved.
----Mrs Williams said that it was alleged by the Stipendiary Stewards that Miss Edmonds had used her whip 28-30 times, as the driver of ELLA POWELL, in the run home. Mr B R Williams, Assistant Stipendiary Steward, showed a video replay of the final 400 metres of the Race.
----Mrs Williams informed the Committee that Miss Edmonds had been fined $200 on 28 July 2006 and suspended for 2 days on 16 November 206 for excessive use of the whip on each occasion. Mrs Williams said that the Stipendiary Stewards were seeking a suspension for 6-8 race days.
----Mr McNally, on behalf of Miss Edmonds, submitted that Miss Edmonds had used the whip too many times but not with a lot of force. He stated that Miss Edmonds had a horse of her own racing at Blenheim on 19 and 21 January 2007 and would like to be able to drive at those meetings.
----Having regard to Miss Edmonds' admission of the breach but also to the fact that this breach was Miss Edmonds' third for excessive use of the whip in the past 5 months, the Committee determined that the appropriate penalty was a suspension of Miss Edmonds' licence for a period up to and including Wednesday, 17 January 2007 ? effectively, six race meetings. In addition, Miss Edmonds was warned by the Committee that, if she continues to offend by using her whip excessively, then penalties issued by Judicial Committees are likely to continue to get harsher.
