Following race 4 a protest was lodged by the informant, Mr D Bradley, rider of MARY ELLEN, pursuant to Rule 876(1), when it was alleged that EASY ON THE EYE placed first by the Judge interfered with the chances of MARY ELLEN placed third by the Judge.

DECISION & REASON:
--Following race 4 a protest was lodged by the informant, Mr D Bradley, rider of MARY ELLEN, pursuant to Rule 876(1), when it was alleged that EASY ON THE EYE placed first by the Judge interfered with the chances of MARY ELLEN placed third by the Judge. This is alleged to have occurred inside the final 50 metres.
----The margins at the post were ¾ of a length and half a head between second and third.
----All connections were informed of the protest.
----Present at the inquiry were:
----D Bradley, rider of MARY ELLEN
--Mr A McNamee, owner/trainer of EASY ON THE EYE
--Mr J Waddell, rider of EASY ON THE EYE
----Mr D Bradley demonstrated the video films and showed that approximately 4 to 5 strides from the post, Mr J Waddell, riding EASY ON THE EYE, moved in making contact with his mount MARY ELLEN. He said he had to stop riding, take a hold in the final 3 strides and with the half head margin it cost him second place.
----Mr J Waddell, rider of EASY ON THE EYE, said Mr Ormsby riding ACCARDO moved out contributing to the tightening. He said he was on the same strip of grass for the final 50 metres, but conceded he moved in, in the last 3 strides.
----Mr A McNamee had nothing to add.
----Mr George, when asked for his assessment, said there was pressure from Mr Waddell onto Mr Bradley on his inside. He said it was apparent on the video that the chances of MARY ELLEN running second were affected.
----The Committee carefully considered all the evidence and reviewed the video films.
----The first question we must address is whether interference did occur. We determined that interference did occur when EASY ON THE EYE moved in and into the line of MARY ELLEN when insufficiently clear of that runner. This occurred approximately 4 to 5 strides off the post.
----We are clearly of the opinion that this interference did affect the chances of MARY ELLEN finishing in a better place.
----In applying our discretion we uphold the protest because:

- There was only half head margin at the post. ----
- Mr Bradley had to take hold of his mount approximately 3 to 4 strides off the post while it was clear that Mr Ormsby on his inside was still riding with the whip. ----
- It was clear that Mr Waddell was not the required distance clear when moving in. --
