Mr Sasada admitted a breach of Rule (871) (1) (d) in that he permitted his mount CATIE CRUZ to shift in when not sufficiently clear of FRAGRANT MIST (M Walker) which had to be checked.

Mr George showed the available film indicating the point of the race when Mr Sasada shifted inwards causing M Walker's mount to be checked.

Mr Sasada and Mr Haworth had no comment.

SUBMISSION ON PENALTY

Mr Goodwin told the committee Mr Sasada was last suspended under this rule on 31 August 2006. He believed the offence was one that required a period of suspension.

Mr Sasada was asked for an indication of his riding engagements.

--

Mr Haworth, representing Mr Sasada told the committee that he had been asked to ride at Auckland on Tuesday 7 November and that he would be riding on the first day of the NZ Cup Carnival on Saturday 11 November.

PENALTY

--

In reaching its decision on penalty the committee took into account Mr Sasada's admittance of the breach and the fact he had confirmed rides on two premier days. (7 and 11 November). The committee was of the opinion that the offence was one that required a period of suspension from race riding from the completion of racing on Saturday 4 November until the completion of racing on Sunday 12 November.
