Under Rule 869 (4) and (8) an information instigating a protest filed by Stipendiary Steward Mr T Taumanu, on behalf of EASTWOOD SAPPHIRE, driven by Mr P Butcher, placed 7th, against JUPITER FRANCO, driven by Junior Driver Miss K Blakemore, placed 1st, on the grounds of interference with about 500m to run.

--Senior Horseman Mr J Stormont represented the connections of JUPITER FRANCO and assisted Miss Blakemore.
--Mr Taumanu demonstrated the incident by use of the video film. He said JUPITER FRANCO moved into the one one and the horse in front of it, FALCON’S FAIR driven by Mr M White broke. Miss Blakemore then moved JUPITER FRANCO outwards sharply causing interference to EASTWOOD SAPPHIRE which broke, lost its chance and caused interference to two other horses which also broke and lost their chances. Mr Taumanu said Ms Blakemore should have taken hold of her horse and gone back.
--Mr Butcher confirmed the outward movement of JUPITER FRANCO resulted in contact with the front leg of his horse.
--Miss Blakemore said she thought there was enough room to come out and that Mr Butcher’s horse was running in a bit. Mr Stormont, who also drove in the race, said Mr White yelled out when his horse broke. He thought Miss Blakemore did the right thing and that she had enough room to come out.

DECISION AND REASONS
--The evidence of Mr Taumanu was confirmed by the video film. I accept Mr Taumanu’s evidence. There clearly was not enough room for Miss Blakemore to move her horse outward when she did. It was a sharp outward movement which resulted in three horses losing their chance.
--The protest is upheld and JUPITER FRANCO is disqualified; the placings then being :
--1st KAMWOOD ROCKET
--2nd WOODLEA BB
--3rd BETWEEN DREAMS
--4th BROADWAY
--5th FALCON’S FAIR
