Decision:

Following race 5 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendary Steward Mr J Oatham that Mr P Taylor, the rider of VALHALLA, permitted his mount to shift out over the final 150 metres causing a check to EL TORRO.

Mr Taylor admitted the charge.

Mr Williamson demonstrated the video films which clearly showed at the 150 metre mark VALHALLA moving out and taking the line of the fast finishing EL TORRO when insufficiently clear. Mr Williamson said that Mr Taylor continued to ride forward and did not straighten his mount.

Mr Taylor said he was having a difficult ride and Tasha Collett had come from a long way back and was finishing fast. He did not realize she was there. He said that the 4 leading horses were all moving out and he was unaware of his outward movement.

PENALTY SUBMISSIONS:

Mr J Oatham said Mr Taylor had an outstanding record, had pleaded guilty but it was a $100,000 race. He submitted a 5 – 7 day suspension would be appropriate.

Mr Taylor said he had commitments until January 3.

Before imposing a fair penalty the committee took into account the following:

1.       Mr Taylor’s outstanding record.

--

 

--

2.       His guilty plea.

--

 

--

3.       Mr Taylor’s level of carelessness which we believe was mid range.

--

 

--

4.       The $100,000 stake but it was an unlisted race.

--

 

--

Normally we believe this offence would warrant a 7 day suspension but because of Mr Taylor’s outstanding record being his first charge since March 07 and other mitigating circumstances we impose a suspension to start after racing on 3 January and conclude after racing on 8 January 2009 (5 days).
