Mr Ng permittted his mount ELUSIVE CHIK to shift inwards near the 100 metres when not sufficiently clear of CHIEF’S DAUGHTER ridden by Ms S Spratt causing interference to that horse and THE SKULL ridden by Mr J Collett.

FACTS:

Stipendiary Steward Mr M Williamson showed and interpreted the film of the incident. Mr Ng struck ELUSIVE CHIK with the whip, the horse moved inwards, Mr Ng used the whip again and the horse moved further inwards causing interference to CHIEF’S DAUGHTER and THE SKULL.  Mr Ng only then attempted to straighten his horse.  Mr Ng said he straightened his horse when Ms Spratt yelled out.  Mr Jenkins said Mr Ng had tried to straighten his horse and also said the horse can be difficult to ride.

Mr Oatham said Mr Ng had had about 260 rides since arriving in New Zealand from Hong Kong late last year.  He said Mr Ng was suspended for 4days for careless riding on 13/12/09 and 4days for careless riding on 19/6/2010.  He said the latest suspension concludes at the end of racing on the 3rd of July.  Mr Oatham said Mr Ng had readily admitted the breach and the offending was mid range on the scale of seriousness.  He submitted that a suspension of 5/6 days was appropriate.  Mr Jenkins on behalf of Mr Ng asked for leniency and referred to the admission and that the horse was difficult to ride.  Mr Oatham also said that Mr Ng was showing great promise as a rider.

The committee takes into account the admission of Mr Ng, the submissions of Mr Oatham and Mr Jenkins, the previous suspensions imposed and agrees the offending was “mid range”.  The committee also takes into account the great promise demonstrated by Mr Ng.

PENALTY:

Balancing the above matters and accepting that some leniency is warranted, Mr Ng’s jockey's licence is suspended for 5days commencing at the end of racing on the 3rd July 2010 and concluding at the end of racing on the 15th July 2010.
