Mr Bullard admitted a breach of rule 638(1)(d) in race 5 in that he allowed his mount AL MAAHA to shift outwards near the 150 metre mark when not sufficiently clear of CHAPARELLA (K Williams), which was hampered. We thus find the charge proved.
--We have viewed the videos of the incident and find that Mr Bullard dictated CHAPARELLA outwards and Ms Williams had to steady. THE BEEKEEPER was also inconvenienced. We accept Al MAAHA, which had a hood on for the first time, over-reacted to Mr Bullard’s urgings.
--We take into account the fact that Mr Bullard’s record can, in our view, be described as good to very good, with 2 breaches of this rule this season. We note, in this respect, he is a busy rider. We also give credit for Mr Bullard’s ready admission of the breach. Mr Bullard indicated he had nothing to say concerning the length of the suspension.
--Race 5, the Dunedin Guineas is a listed race, and we note that the interference to CHAPARELLA may have had some influence on the chances of that horse. Mr Oatham has described the breach as mid range and we agree with that assessment. He asked for a suspension for a period from 10 calendar days to 2 weeks. We believe that, balancing all these matters we have identified, a suspension from the end of racing today up to and including Friday 19 February is appropriate.
