Prior to races 3 and 7 an information was filed pursuant to Rule 330(3)(c). The informant, Mr Davidson, alleged that Mr Ahmad failed to make the weight for CANNYMAC (race 3) and DANE FANTASY (race 7).
Mr Ahmad admitted the breach and was represented by his employer, Mr P Moroney.
Mr Davidson told the Committee that Mr Ahmad had two rides for the day and before his first ride presented himself at 56 kilos. He was able to claim 4 kilos so was well in excess of the acceptable weight. He was replaced on both horses.
--Mr Moroney said Mr Ahmad had been confident all week that he would be able to make at least 53 kilos for his first ride on CANNYMAC in race 3. Mr Moroney said Mr Ahmad had wasted hard all week and had been to the sauna last night. He said when Mr Ahmad weighed himself on his own scales last night he was 52 ½ kilos. There was no explanation for him being 56 kilos on race day.
--PENALTY SUBMISSIONS:
Mr Davidson said that Mr Ahmad was well in excess of the expected weight and having to be replaced was a real inconvenience to connections of both his mounts. He submitted a fine of $200 - $400 would be appropriate.
Mr Moroney said any fine would act as a hard lesson for Mr Ahmad.
--PENALTY:
The Committee carefully considered all evidence and submissions before imposing an appropriate penalty. Mitigating factors taken into account were Mr Ahmad’s guilty plea and that this was his first offence. However, in this case Mr Ahmad was well in excess of the required weight having to be replaced on two horses. The Committee reminded Mr Ahmad of his obligations under this rule. Having taken all the above factors into account we impose a fine of $300.
