Following the running of race No 4, an information was filed alleging a breach of rule 864 (2) (d)
--The informant was Mr B J Van Kan and the defendant Mr M Berger the trainer of Coburg in this race. The information alleged that trainer M Berger failed to apply or affix the removable earplugs as not to malfunction on the horse Coburg (P C Ferguson). The ear plugs failed to release with approximately 100 meters to run when in the lead.
--Mr Berger admitted the breach and was present at the hearing.
--Mr Berger stated that he had applied the equipment as per normal and the only explanation he could offer was that the cord had become entangled with the boring pole of this horse.
--The video of the run home was played and this showed Mr Ferguson having trouble activating this equipment. Submissions were heard from both Mr Van Kan and Mr Berger on penalty.
--Decision And Reasons.
--Having taken into account the admission of the breach by Mr Berger a fine of $150.00 was imposed in this instance.
