Mr Escott alleged that Junior Horseman R Tither, JAMES BURKE, drove carelessly contacting the sulky of HOGWORTS EXPRESS, L Mathieson, resulting in the gelding breaking with approximately 400 metres to run.
--Video evidence of the incident was shown and supported Mr Escott's allegation. As Mr Tither admits the charge, under Rule 1111 (1) (d), the charge is proven.
--Submissions as to penalty were heard. Mr Tither had previously (on 30 November 2006) been suspended at Forbury Park for this rule and was suspended for 2 days and fined $250. Mr Escott asked for a 2 day suspension in this case.
--Mr Tither said he was due to drive in a Junior Drivers' race on 11 February at Wyndham and if he missed the drive it is possible a replacement may not be found. He felt that a lesser penalty was appropriate.
--Finding
--We uphold Mr Escott's request for a 2 day suspension which will be from the close of racing today up to and including Sunday 11 February 2007. We did consider a 3 day suspension but giving credit for Mr Tither's admission and accepting Mr Escott's proposal, we will leave the suspension at 2 days. We do, however, strongly wish to remind Mr Tither of his obligations to other drivers.
