Stipendiary Steward Goodwin showed the film of the incident and pointed out the gesture was made just short of the post, it was Mr. Cunninghams first charge under this rule, this was one of his first rides back after a spell away from race riding and it was a “catch ride”. He asked for a monetary fine of $300.00. Mr. Cunningham had nothing to say but did concur with Mr. Goodwins comments.

Mr. Cunningham in coming to our decision to impose a monetary penalty, we took into account your guilty plea, that this was your first offence under this rule and the fact the gesture was made about one stride short of the post.

However, gestures short of the post can create incidents and the rule must be enforced. You are fined the sum of $300.00.
