Decision:

Following Race 10 an Information was filed pursuant to rule 871 (1) (D).  The Informant, Mr J Oatham, alleged that 100 metres after the start LE GRANDE (C Parish) allowed his mount to shift in dictating GUSHER (N Harris) into the line of THE MOOSE IS LOOSE (J Collett) who had to check his mount causing him to lose ground.

Following Race 10 an Information was filed pursuant to rule 871 (1) (D).  The Informant, Mr J Oatham, alleged that 100 metres after the start LE GRANDE (C Parish) allowed his mount to shift in dictating GUSHER (N Harris) into the line of THE MOOSE IS LOOSE (J Collett) who had to check his mount causing him to lose ground.

Mr Parish pleaded guilty.

Mr Oatham demonstrated the film which clearly showed approximately 100 metres after the start, Mr Parish riding LE GRANDE moving in from a 4 wide position and in doing so take the rightful line of GUSHER (N Harris).  Mr Parish was not the required distance clear of Mr Harris when moving in from a 4 wide position to be on the running rail.  This also resulted in 2 more runners being crowded.

Mr Parish said he was going forward and was really only aware of Mr Harris on his inside.

PENALTY SUBMISSIONS

Mr Oatham said Mr Parish had a good record with no charges in the last 12 months.  He said although his level of carelessness was reasonably high the resultant interference was at the low end.

Mr Parish told the Committee he was released from 2 rides at Taupo on 9 September 2009 and wished to start the suspension immediately.

PENALTY

--

The Committee took into account Mr Parish’s guilty plea, his excellent record and the interference he caused.

--

Accordingly we impose a suspension on Mr Parish from riding in races which starts today 5 September and conclude after racing on 12 September 2009 (4 days).
