Following race 9 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendary Steward Mr J Oatham, that Mr M Cameron, rider of LADY CAVALIER allowed his mount to shift inwards near the winning post on the first occasion when not sufficiently clear



Following race 9 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendary Steward Mr J Oatham, that Mr M Cameron, rider of LADY CAVALIER allowed his mount to shift inwards near the winning post on the first occasion when not sufficiently clear of SARAJAY (N Harris) who was forced onto the line of THEE AULD HUSSIE (B Heard) who was checked.

Mr Cameron did not admit the breach.

Mr Cole demonstrated the video films and showed where, at the winning post on the first occasion, Mr Cameron angling his mount LADY CAVALIER towards the running rail to gain a better position. In doing so he took the line of SARAJAY (N Harris) on his inside when insufficiently clear of that runner. SARAJAY was then forced into the line of THEE AULD HUSSIE who received a severe check as a result. Mr Coles pointed out some tightening to the inside horses just before Mr Cameron moved across but this came mainly from VERCORS moving out slightly and had nothing to do with the subsequent interference caused by Mr Cameron.

Mr N Harris (rider of SARAJAY ) gave evidence and said that just past the winning post on the first occasion he was forced to move in through Mr Cameron coming across and taking his line when only 1 length clear.

Mr Cameron, rider of LADY CAVALIER said he believed Mr Harris moved in before he himself had started his inward movement and the tightening was caused by the inside horses moving out

The committee then retired to consider the evidence.

DECISION:

--

The committee considered all evidence and are clearly of the opinion that Mr Cameron did move inwards and take the line of SARAJAY when insufficiently clear of that runner. We considered Mr Cameron's evidence that the interference was caused by the inside horses moving out but we are clear in our view that this was before Mr Cameron moved in. It is clear on the film there was further tightening caused by Mr Cameron taking Mr Harris's line. This caused SARAJAY to move in on THEE AULD HUSSIE who was severely checked.

Accordingly we find the charge proven.

PENALTY:

--

Mr Oatham produced Mr Cameron's record which showed Mr Cameron had 2 suspensions in the last 6 months. He said that there were some mitigating circumstances in this case, but asked the committee to consider this was a Group 2 race for $120,000. He believed a suspension was appropriate.

Mr Cameron said that he rode extensively over the North Island.

The committee considered these submissions and took into account the following:-

--

1/ The level of interference caused by Mr Cameron.

--

2/ Any consequences as a result.

--

3/ Status of the race ? being a Group 2 for a stake of $120,000

--

4/ Mr Cameron's record.

--

In reaching a fair and correct decision and taking all factors into account we believe a suspension is necessary.

--

As this is a Group 2 race we have considered imposing a fine in addition to a suspension. Because of the stage of the race where the interference occurred and also that there was some pressure from the horses inside just prior to the incident we believer a suspension only is appropriate.

--

Accordingly we suspend Mr Cameron from after racing on 2 May up to and including racing on 13 May. (5 days)
