Following the running of Race 10, the Buller Refrigeration & Electrical Pace, an information was laid by Stipendiary Steward Mr N. G. McIntyre against Mr D. J. and Mrs C. M. Butt, licensed trainers of “Ohoka Nevada” (2), alleging a breach of Rule 849(2).  It was alleged that the defendant presented “Ohoka Nevada” with an incorrectly numbered saddle cloth.

Following the running of Race 10, the Buller Refrigeration & Electrical Pace, an information was laid by Stipendiary Steward Mr N. G. McIntyre against Mr D. J. and Mrs C. M. Butt, licensed trainers of “Ohoka Nevada” (2), alleging a breach of Rule 849(2).  It was alleged that the defendant presented “Ohoka Nevada” with an incorrectly numbered saddle cloth.

Mr Butt had indicated on the information that this breach was admitted and that they did not wish to attend the hearing.

Mr McIntyre gave evidence that the horse had entered the birdcage with the No. 1 saddle cloth instead of No. 2.

Mr McIntyre advised that Mr and Mrs Butt had two previous convictions for a breach of this Rule.  On 20 April 2008 they were charged in relation to two of their stable runners having their numbers transposed in the same race.  On this occasion they were fined $200-00, as there were two breaches of this Rule.  On 7 December 2008 they were again charged with a breach of this Rule, and on this occasion they were fined $150-00.

As this was the third breach of this Rule in the last 12 months Mr McIntyre recommended a fine of $200-00.

Presenting a horse with an incorrect saddle cloth is very careless, and should not happen.  I accept that the fine of $200-00 in April this year was because there were two offences.  I agree with Mr McIntyre that continuing to breach this Rule must result in increased fines.  For these reasons I agree that a fine of $200-00 is appropriate, and Mr and Mrs Butt are fined $200-00 accordingly.
