DECISION & REASON:

--

Following race one an Information was filed pursuant to Rule 302(5)(a) when it was alleged by Mr C George that Mr K Rae, trainer of OPUS DEI, used an unregistered stable hand to assist him.

--

--

Mr Rae admitted the charge, but said he did not employ this person but was only helping her rehabilitation after suffering head injuries.

--

--

Mr George stated the person involved was clearly unregistered, and therefore Mr Rae was in breach of the Rule. He believed a fine of $50 - $100 to be appropriate.

--

--

PENALTY:

--

The Committee considered all submissions and took into account Mr Rae’s guilty plea and the fact that Mr Rae was only trying to help this person. However, it was pointed out to Mr Rae his obligations under the Rule. Accordingly we impose a fine of $75.
