Following race seven an information was filed pursuant to Rule 865A by the informant, Mr J Oatham. He requested a ruling as to whether POETIC MUSIC was denied a fair start.

Following race seven an information was filed pursuant to Rule 865A by the informant, Mr J Oatham. He requested a ruling as to whether POETIC MUSIC was denied a fair start.
--Mr Oatham demonstrated the video films which clearly showed gate number 11 from which POETIC MUSIC started still completely closed when the others had all opened. Mr Oatham said POETIC MUSIC was normally an on the pace runner and on this occasion had to force its way out of the gates. He said the horse had to be ridden hard to be outside of the leader.
--Mr J R Collett, rider of POETIC MUSIC, said his mount usually flies the gates, but on this occasion had to force its way out. However, he believed his finishing position was not affected.
--Mr Oatham in summing said in his opinion POETIC MUSIC was denied a fair start and believed it cost him 1 – 1½ lengths.
--The Committee carefully considered all evidence and is in no doubt that POETIC MUSIC was denied a fair start. This is because its starting gate was still completely closed when all others were open. This caused POETIC MUSIC to force its way out, losing ground as a result. Accordingly we declare POETIC MUSIC a non-starter with all bets refunded.
