Decision:

Following Race 4 an Information was filed pursuant to rule 638 (1) (d).  The Informant, Mr Coles, alleged Mr Z Razali, rider of MIND READER, shifted out abruptly and checked DENALI DANCER (J Collett).  This occurred at the 300 metres.

Following Race 4 an Information was filed pursuant to rule 638 (1) (d).  The Informant, Mr Coles, alleged Mr Z Razali, rider of MIND READER, shifted out abruptly and checked DENALI DANCER (J Collett).  This occurred at the 300 metres.

Mr Razali pleaded guilty and was represented by his trainer Mr C Ritchie.

Mr Williamson demonstrated the video films which clearly showed Mr Razali, at a point approaching the 300 metres, looking for a run.  As his mount was travelling so well he angled his horse out quite abruptly and into the line of DENALI DANCER when only ¾ of a length clear of that runner.  It was evident to the Committee that Mr Collett had to check quite severely.

Mr Razali had nothing to say.

Mr Ritchie said while Mr Collett received quite a severe check he believed this was a case of Mr Razali becoming excited when he thought he could win the race.  This was compounded by his inexperience.

PENALTY SUBMISSIONS

Mr Coles submitted this was Mr Razali’s first ever charge and he had had only 10 rides.  However Mr Collett had received quite a sharp check.  He believed a 4 – 5 day suspension was appropriate.

Mr Razali confirmed he had no upcoming engagements.

The Committee carefully considered all the evidence and submissions and in mitigation took into account Mr Razali’s inexperience, this was his first charge and he had pleaded guilty.  However these factors must be balanced against the severity of the check received by Mr Collett.

Accordingly we impose a suspension on Mr Razali from riding in races which is to start after racing on 15 November and concludes after racing on 22 November 2009(4 days).
