Mr Escott alleged that Mr D Johnston, driving HERE COMES HOMER, used his whip unnecessarily over the concluding stages on a beaten runner.

--

Video evidence was shown and it was claimed he had used the whip about 27 times in the last 400 metres. However, it was concern over the final 400 metres where he was driven out without any possible chance of finishing in the first six. There were six in front of him and a seventh finishing over him. This is the standard set in use of whip Regulations.

Mr McIntyre, the Stipendiary Steward, felt that Mr Johnston had no judgement as to when his horse was beaten. Mr Johnston said he knew his horse and he would stop unless he was driven out strongly.

Mr McIntyre referred to the Mathew Enright case where it was held that all horses are meant to compete under the same rules and even if he needs to be hard driven it must still be within the rules. When asked by Mr Steel if his horse had raced on grass previously, he said yes, and it had performed poorly on the one occasion. Mr Johnston then claimed he is being victimised by the stipendiary stewards.

After considering the evidence, the Committee upholds the charge and asked for submissions as to penalty.

Mr Escott asked for a fine of $250 while Mr Johnston asked how long a suspension might he be facing.

Mr Escott said as Mr Johnston drives only 1 or 2 horses that he trains he would require at least a one month suspension. Mr Johnston said that would be acceptable to him.

We therefore suspend Mr Johnston's licence for 1 month from the finish of racing tonight (4 February 2007) up to and including Saturday the 4th of March 2007.
