Following the running of Race 1, the Blue Acres Jumpers Flat, Ms J Lewis the rider of SAM MCLAY was charged with a breach of Rule 871 (1)(d) ? Careless riding.

--It was alleged that approaching the first turn Ms Lewis allowed her mount to shift inwards when not clear of TRIPLEPAN (K Murray), CASINO KING (K Watson) and GALLANT SON (R Eynon) with the latter having to be checked and loose its rightful line of running.
--Ms Lewis denied the breach of the rule.
--DECISION AND REASON.
--When making his submission Mr Goodwin called evidence from riders Eynon, Murray and Watson. He also used the films of the race to support his submission.
--The thrust of the evidence adduced from witnesses was that as the field made its way to the first bend SAM MCCLAY who was racing wide on the track has moved inwards and crowded all those runners on its inside. The ultimate consequence being that GALLANT SON has come into contact with the running rail and has lost its rightful position in the race.
--Ms Lewis, when making her submission, conceded that she was ?probably not clear? however argued that notwithstanding her inwards movement there was still sufficient room for the runners on her inside, and that accordingly the checking of GALLANT SON by Mr Eynon had been somewhat of an over reaction.
--Ms Lewis also demonstrated, by way of the films, where she had corrected her mount as soon as she realised there were still runners on her inside.
--When assessing the evidence and after having carefully considered all that has been presented, the committee finds that the checking of GALLANT SON by Mr Eynon has been solely attributable to the actions of Ms Lewis moving her mount inwards when not the requisite distance clear of the runners on her inside.
--We acknowledge Ms Lewis submission that she had corrected her horse when she had realised she was crowding those on her inside however, in the committees view, the damage had been done.
--We do not accept that any other rider other than Ms Lewis was responsible for what occurred to GALLANT SON and Mr Eynon.
--We therefore find the charge proven.

PENALTY
--Prior to hearing submissions on penalty Mr Goodwin presented Ms Lewis's record, this demonstrating no previous breaches of the careless riding rule.
--It was Mr Goodwin's submission that this was a breach best dealt with by way of a term of suspension. He believed that the matter was of significance as the check suffered by GALLANT SON was relatively severe.
--Ms Lewis, when making her submission again reiterated her belief that Mr Eynon had over reacted. She also outlined her prospective riding dates.
--Having regard to all factors the committee finds that in this case the appropriate penalty is a term of suspension.
--When determining the quantum to be imposed we are mindful that this incident has resulted in several runners being forced off their intended line of running and one runner has come into solid contact with the running rail.
--However against this is that this is the first time that Ms Lewis has appeared before a committee charged with a breach of careless riding and some credit is to be given for this.
--On balance, having regard to all factors, we find that Ms Lewis be suspended from the conclusion of racing on Wednesday 18th April up to and including racing on Thursday 26th April. (3 days)
