An Information instigating a Protest was lodged by Stipendiary Steward Mr T TAUMANU

following the running of Race 11 on behalf of the connections of horse 6 ROCKAFELLA

(Driver G Gillies) placed 6th by the Judge, against horse 12 GIRL OF YOUR DREAMS

(Driver T Mitchell), placed 1st by the Judge on the grounds of interference.

Both Drivers were present to represent the connections.

Evidence was given by Stipendiary Steward Mr J Muirhead with reference to video tapes of the commencement of the race. This clearly showed Girl of Your Dreams to move outwards just after the start coming into contact with Rockafella resulting in the sulky wheels locking up. Girl Of Your Dreams subsequently broke up was taken wide and settled at the rear of the field. Rockafella was clearly interfered with and also settled near the rear of the field.

Mr Muirhead submitted that Rockafella had clearly lost 5 lengths due to this incident and had finished in 6th place 4.3 lengths behind Girl Of Your Dreams

Approximately 150 metres further into the race Mark Holmes also broke and most of the field was checked including both Rockafella and Girl Of Your Dreams

Mr T Mitchell gave evidence admitting that his horse had hung and galloped after the sulky wheels locked up but contended that had Rockafella been travelling properly the entanglement would likely have been avoided, as his lack of pace had contributed to the locking up.

He also submitted that as a result of the interference Girl of Your Dreams had ended up at the rear of the field with no advantage and was further disadvantaged with the checking of the majority of the field including Rockafella when Mark Holmes broke.

Mr G Gillies gave evidence confirming the incident and admitted that Rockafella had no gate speed and that he didn?t push him from the start.and that this had resulted in him being unable to move forward faster and free of interference when his sulky connected with Girl Of Your Dreams

He stated that his horses chances were not affected by the interference caused.

It is obvious that Girl Of Your Dreams did cause interference to Rockafella just after the start of the race with both horses ending up at the tail of the field. Mr Gillies has conceded that his horse's chances were not affected by the interference.

It is also obvious that with the exception of Motu Beach Boy, Winning Big and Whodatdare, the field was again impeded by the breaking of Mark Holmes and this had a major effect on the running of the race

--

Taking all of the matters into account I cannot accept the tenuous link between the initial interference caused by Girl of Your Dreams on Rockafella and the final result, particularly with what occurred in the intervening stages of the race.

The Protest is dismissed and the Judges placings will stand
