Decision:

Following the running of the Yellowtail 1200 Mr S. Fieldes rider of ADORA admitted a charge of careless riding under rule 871(1)(d).

Mr A. Fieldes appeared in support of Mr Fieldes at the hearing.  Through the head and side on films of the final 400 metres Mr Goodwin, Stipendiary Steward, submitted that Mr Fieldes racing near the rail angled his mount out when insufficiently clear of CAN KEEP A SECRET (N. Harris) and caused that horse to be taken hold of and checked out of its rightful running line.

Mr A. Fieldes submitted that the incident was quite minor and that Mr S. Fieldes had genuinely believed there was room for him to move out.

On the issue of penalty Mr George that advised although this was Mr Fieldes' first such charge a term of suspension was called for.

Mr Fieldes sought credit for a quick acceptance of the charge and invited the Committee to view the degree of carelessness as quite minor.

The Committee considers that Mr Fieldes actions were more the consequence of an error of judgement but nevertheless CAN KEEP A SECRET was significantly disadvantaged in the incident.  We believe a term of suspension is the appropriate penalty and in setting that we have given Mr Fieldes credit for his frank admission of the charge.  Mr Fieldes is suspended from the close of racing on 24 January 2007 until the close of racing on 3 February 2007.
