Following race 6 a protest was lodged by trainer Mr T Mitchell pursuant to Rule 876(1) when it was alleged that GIORGIO or its rider placed 1st by the Judge interfered with the chances of ELECTRONIC SOCKS placed 2nd by the Judge.

--The interference occurred in the final straight. The Judges margin between 1st & 2nd was a head.

Present were Mr T Mitchell, Mr P Ferguson, and rider E Dalley representing ELECTRONIK SOCKS.

Mr G Newham and rider C Ormsby represented GIORGIO.

Mr Mitchell demonstrated the head on video. As the field progressed down the straight GIORGIO had the rails run and was in the lead. ELECTRONIC SOCKS could be seen racing at the rear of the field but on the rails. GIORGIO could be seen to roll off the rails and then eased back again. ELECTRONIC SOCKS could be seen to be making a strong run. At the 200 metres Mr Dalley had to check his mount off the heels of GIORGIO. After being checked he finished strongly to be within a head at the finish.

Mr Newham, in GIORGIO’S defense said that although his horse had moved out and then in the inward movement was made when he was well clear of ELECTRONIC SOCKS and therefore there was no case to answer. Mr Ormsby strongly supported Mr Newham’s interpretation of the incident.

Stipendary Steward Mr Coles said that he felt there was always sufficient room between the two horses.

DECISION: The committee, after reviewing all evidence including the videos agrees that GIORGIO was always sufficiently clear of ELECTRONIC SOCKS when movement was made. The protest is therefore dismissed and judge’s placings stand.
