Decision:

Following Race 2 an information was lodged pursuant to Rule 871(1)(d) when it was alleged that Mr T Harris permitted his mount NATSINGA to shift inwards at the 1300 metres when not sufficiently clear of PORIKA TRACK who was checked.



Following Race 2 an information was lodged pursuant to Rule 871(1)(d) when it was alleged that Mr T Harris permitted his mount NATSINGA to shift inwards at the 1300 metres when not sufficiently clear of PORIKA TRACK who was checked.

Mr Harris was represented by Mr L Noble and he did not admit the charge.

Mr J Oatham demonstrated the head-on and side-on videos. Soon after the start Mr Harris, who had drawn 16 at the start an inward movement towards the running rail. He continued in until, as he started to settle, he moved in and took the line of PORKA TRACK who had to be checked. At no time, Mr Oatham claimed, was Mr Harris the required distance clear, and he showed the evasive action that Miss Cropp had to take.

Mr Noble claimed that there was room available for Mr Harris to make the move that he made. He called Miss Cropp to support this situation. Miss Cropp, however did not agree with this supposition and in fact said she had to check out of her position because of Mr Harris taking her rightful line.

DECISION

--

After reviewing the evidence as presented the committee preferred the evidence of Mr George and find Mr Harris guilty as charged as it could be clearly seen that his actions were responsible for Miss Cropp having to check her horse.

--

PENALTY

--

Mr George gave Mr Harris’s moderate record and asked for a suspension of 5-8 days.

Mr Harris had nothing to add.

The committee suspend Mr Harris from race riding from after the completion of racing on 2 January till the completion of racing on 12 January. (7) days.
