Under Rule 869 (8) an information instigating a protest filed by Stipendiary Steward Mr J Muirhead on behalf of WHATAWEE BABE driven by Mr I Brownlee, placed third by the Judge, against CYCLONE NIGHT, driven by Mr P Ferguson and placed first by the Judge, on the grounds of interference in the home straight.
Under Rule 869 (8) an information instigating a protest filed by Stipendiary Steward Mr J Muirhead on behalf of WHATAWEE BABE driven by Mr I Brownlee, placed third by the Judge, against CYCLONE NIGHT, driven by Mr P Ferguson and placed first by the Judge, on the grounds of interference in the home straight.
--Mr Brownlee represented the connections of WHATAWEE BABE and Mr Ferguson and trainer Mr G Dixon the connections of CYCLONE NIGHT.
--Mr Muirhead said that initially he was suspicious that the outward movement of CYCLONE NIGHT in the home straight had affected the chances of WHATAWEE BABE, but he didn’t blow the siren because he wasn’t sure. Mr Brownlee told the Stipendiary Stewards he wanted to protest and Mr Muirhead agreed to assist by filing the information. Mr Muirhead referred to the provisions of Rule 869 (4) and the Home Straight Regulations. Mr Muirhead demonstrated the incident by use of the video film. He said initially there was outward movement by MO CULLEN and that caused CYCLONE NIGHT to move outwards but he felt Mr Ferguson could have closed the gap up.
--Mr Brownlee said the picture told it all. He was forced over extra ground and if he had been able to keep a straight line he would have won.
--Mr Ferguson said MO CULLEN had dictated his line, there was no way he could pull back in and that Mr Brownlee had been able to drive out his horse at all times.
--Mr Dixon agreed with the evidence of Mr Ferguson and stressed that the line of CYCLONE NIGHT had been dictated by MO CULLEN.
--DECISION & REASONS :
--It was clear from the video film that the line of CYCLONE NIGHT had been dictated to by MO CULLEN. Mr Brownlee was able to drive his horse out. Mr Ferguson did take corrective action about 50 – 75m from the winning post. In any event, I was not satisfied that being forced wider prevented WHATAWEE BABEW from finishing in a better position. The protest is dismissed.
