Decision:
Following the running of race 6, the www.raceshop.co.nz Stayers, Mr M Walker was charged with careless riding under rule 871 (1) (d). Information 5580 alleged that near the 1500m he permitted his mount MISS SIVIVATU to shift in when not clear of BEAU SON (J Riddell) which had to be checked.
--Rule 871(1)(d)) states “Every rider commits a breach of these rules who in the opinion of the Judicial Committee is guilty of riding that was ......careless”.

Following the running of race 6, the www.raceshop.co.nz Stayers, Mr M Walker was charged with careless riding under rule 871 (1) (d). Information 5580 alleged that near the 1500m he permitted his mount MISS SIVIVATU to shift in when not clear of BEAU SON (J Riddell) which had to be checked.
--Rule 871(1)(d)) states “Every rider commits a breach of these rules who in the opinion of the Judicial Committee is guilty of riding that was ......careless”.
--Mr Walker indicated on the information he admitted this breach of the rules and he confirmed this at the hearing. He also agreed he understood the charge and the rule it was laid under.
--Chief Stipendiary Steward Mr Sanders replayed the videos of the incident which showed Mr Walker racing four horse widths off the fence going out of the home straight and allowing his horse to shift inwards when not the required distance clear causing BEAU SON to be checked. Also affected in the incident was TILT ridden by Ms L Allpress.
--Mr Walker said he thought he was three off the fence and clear when he moved inwards however after viewing the film he realised that he had “cut it fine” which is why he admitted the breach. He said that he should have taken more care and could have done more to ensure that he was clear of Mr Riddell on BEAU SON.
--Penalty Submission
--Mr Sanders said Mr Walker had been suspended for four days for careless riding on 15 April 2009 and had also been suspended for seven meetings, for what he believed was a minor offence, at the recent Brisbane winter carnival. He said that prior to these two incidents he had not been charged under this rule in the previous two years. He said Mr Walker was a premier rider who rode extensively throughout New Zealand and overseas therefore his record must be considered a good one. His submissions were for a suspension in the vicinity of four days.

Mr Walker asked the Committee to note his good riding record and advised that he had riding commitments on Wednesday July 1st. He requested any suspension begin after that date as he did not want to let any owners or trainers down.
Decision
--In coming to a decision on penalty the Committee considered all the submissions put before it. We have taken into account Mr Walker’s admittance of the breach, his good riding record and whilst there was movement inwards we do not believe the degree of interference to be high.
--Mr Walker is suspended from the close of racing on Wednesday 01 July 2009 to the close of racing on Sunday 05 July 2009 that being four days.
