Mr Todd admitted the breach and indicated he did not wish to be present.

Mr Ching explained that after race 2 he went to talk to Mr Todd about his ride in that race and found that he was not in the jockeys’ room. It transpired that Mr Todd had changed into his street clothes and was outside the designated area as he gone to meet his mother. He said had Mr Todd asked him for permission to leave he would have granted it.

Mr Ching asked for a fine in the range of $100 to $200. We accept this suggestion is appropriate. There is no recommended penalty for breach of this rule in the Penalty Guide. However, we are aware that previous breaches in the South Island have resulted in fines of $100. One person was an apprentice and the other a jumps jockey. Mr Todd is an experienced rider and should have known better. There was an element of premeditation in that he changed his clothes before leaving the designated area. He has no prior breaches of this rule and has admitted the breach. Taking all the matters into account, we impose a fine of $150.
