DECISION AND REASONS:
--Following the running of Race 10, 123soccer.com Mobile (PBD) Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Open Horseman, Mr T S Chmiel, alleging that Mr Chmiel, as the driver of STRAWBERRY FIELDS in the Race, used his whip excessively in the run home.
----The information was filed on race night and the hearing of the charge was adjourned to the meeting of Rangiora Harness Racing Club on Sunday, 29 April 2007.
----Mr Chmiel was present at the hearing of the information at the meeting of Rangiora Harness Racing Club held at Rangiora on Sunday, 29 April 2007. Mr Chmiel admitted the breach which, accordingly, was found to be proved.
----Mr McIntyre informed the Committee that Mr Chmiel had used the whip 23 times inn the run home and, in the middle stages of the run home, had used it 13 times "in a rapid-fire motion". Video replays of the relevant portion of the Race were shown which confirmed Mr McIntyre's submission.
----Mr McIntyre stated that Mr Chmiel had a clear record. He recommended a fine of $200.
----Mr Chmiel stated that he was only hitting the cart in the middle stages. His horse was "real lazy", he said, but had fought back after being headed and was beaten by a head. He acknowledged that it might have looked bad. The striking of the cart "got her going" as it made a lot of noise, Mr Chmiel said. It was his first offence of excessive use of the whip. He acknowledged that he was aware of the guidelines relating to use of the whip.
----The Committee took into account the submissions of the parties, Mr Chmiel's admission of the breach and his good record. He was fined the sum of $200.
