Following Race 9 an information was filed pursuant to Rule 530(2)(b) when it was alleged by the Informant, Stipendiary Steward Mr J Oatham, that Mr L Callaway was guilty of excessive use of the whip.

DECISION AND REASON:

Following Race 9 an information was filed pursuant to Rule 530(2)(b) when it was alleged by the Informant, Stipendiary Steward Mr J Oatham, that Mr L Callaway was guilty of excessive use of the whip.

--

Mr Callaway admitted the breach of the rule. Mr Callaway was represented in the inquiry by Trainer, Mr R McCarroll.

--

Mr Robinson, Assistant Stipendiary Steward, demonstrated the video film and showed Mr Callaway striking his mount 15 times before the 200 metre mark, without giving his mount any respite.

--

Mr Callaway said in his submissions, that his mount was lazy and was a horse that had to be ridden out. He responded to the whip and came from a long way back to finish third.

Mr McCarroll had nothing further to add.

Mr Oatham, said in his submissions, that this was Mr Callaway's first offence under this rule, but did receive a verbal warning in February 2006.

Penalty:

The Committee considered all submissions, and took into account Mr Callaway's guilty plea and that this was Mr Callaway's first offence under this rule. However, it was a blatant breach of the rule with Mr Callaway not making any effort to give his mount respite after 6 strikes of the whip.

Accordingly, a suspension of Mr Callaways licence was imposed, to start after the conclusion of racing on 22 July 2006 and conclude after the finish or racing on the 29 July 2006 (3 riding days).
