Prior to Race 1 Mr. R. Neal lodged an information for a request for a ruling under Rule 520 (3). The ruling related to a riding engagement dispute between Mr. Larry Reid and Mrs. Lisa Allpress.
The information reads:
Trainer L. Reid has advised the Stewards that L. Allpress agreed to ride TOUCH O’FEIST in Race 5 today while Mrs. Alpress contends that she did not accept the ride but rather has an engagement for HELL YEAH. The committee is requested to determine the status of each engagement.
Mr. Reid explained to the committee that he had to find four riders for horses he had racing today at Trentham.
He spoke, via telephone, to Mrs. Alpress on Monday 6th March asking her if she could ride SONNY WELLINGTON in the 3 year old race and TOUCH O’FEIST in the rating 70. She said that she already had a commitment in the 3 year old race but could ride the other horse.
After finding riders for all his horses he advised the Racing Bureau (on line) early on Wednesday morning of all the riding engagements.
Mr. Reid was therefore concerned to receive a phone call from the Bureau on Thursday saying that Mr. G. Vile had named Mrs. Allpress as the rider of HELL YEAH in the same race. Mrs. Alpress rang him at lunchtime saying that she had never committed to riding his horse.
It was at this stage that the Stewards became involved.
Mrs. Alpress explained her version of the events.
While agreeing that she had spoken to Mr. Reid via telephone on the Monday night she was adamant that she did not commit to riding TOUCH O’FEIST. She said that she told him she would make a decision once nominations were out, which is her usual custom. She explained to the committee that she always calls the trainers back during the week to confirm rides with them.
The next day (Tuesday) at the trials Mr. Vile asked her to ride HELL YEAH at Wellington and having ridden the horse twice before for a win and a second place she immediately confirmed that she would.
Mr. Neal said that Mrs. Allpress organizes all her own rides and that the Stewards always find her very professional.
--DECISION
This was a regrettable situation for everyone concerned but especially for Mr. Reid who believed he had secured riders for all four of his horses only to be told that he hadn’t.
Mrs. Alpress is a senior rider and is well known for her professionalism within the racing industry.
In this instance there has been a genuine misunderstanding between Mr. Reid and Mrs. Allpress.
If Mrs. Alpress had made the final decision to ride TOUCH O’FEIST she would have followed her usual procedure of ringing Mr. Reid after nominations to confirm. She did not do this so it is our opinion that Mrs. Allpress did not commit to the ride.
Mr. Reid however would not necessarily have known that Mrs. Allpress always follows up her confirmed rides with a phone call so he could be forgiven for assuming that she would ride his horse.
This is an unfortunate example of one party believing one thing and the other party believing something else.
The committee has been asked for a ruling in this matter and after considering all submissions the ruling is that Mrs. Allpress is the confirmed rider of HELL YEAH in Race 5.
