Following the running of Race 10, Morrison’s Saddlery & Avon City Ford Mobile Pace, an information instigating a protest was filed by Stipendiary Steward, Mrs K R Williams, against THREE SUGARS (B N Orange), placed 5th by the judge, on the ground of breaking from its gait pursuant to Rule 870 (3) and the Breaking Horses Regulation and, specifically, that it “broke in excess of 50 metres in the run home”.

DECISION AND REASONS:

Following the running of Race 10, Morrison’s Saddlery & Avon City Ford Mobile Pace, an information instigating a protest was filed by Stipendiary Steward, Mrs K R Williams, against THREE SUGARS (B N Orange), placed 5th by the judge, on the ground of breaking from its gait pursuant to Rule 870 (3) and the Breaking Horses Regulation and, specifically, that it “broke in excess of 50 metres in the run home”.

Mr J H Gameson, trainer of THREE SUGARS, had endorsed and signed the information form “I do not contest the protest”.

--

Rule 870 (3) provides as follows:
Any horse which breaks from its gait shall promptly regain its proper gait.

The relevant provision in the Breaking Horses Regulation provides as follows:
For the avoidance of doubt and in order to clarify the situation for all parties concerned, the following shall apply with regard to breaking horses:

--

(b) Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870 (3) in that it has failed to promptly regain its proper gait.

Mrs Williams showed a video replay of the final stages of the Race. She pointed out THREE SUGARS, in 2nd or 3rd placing with approximately 50 metres to run, break from its gait and continue on in the break to the winning post. Mrs Williams alleged that THREE SUGARS had broken from its gait prior to the 50 metres mark on the inside of the track.

In the Committee’s view, there was an element of doubt as to the exact distance over which THREE SUGARS had galloped within the final 200 metres of the Race and whether that distance was greater than the 50 metres specified in the Regulation. However, the Committee had regard to Mrs Williams’ evidence, Mr Gameson’s admission and the fact that there was no 5th stake payable in the Race.

The protest was upheld and THREE SUGARS was disqualified from the Race. Consequent upon the disqualification, the amended placings for the Race are:-
