DECISION & REASON
--Following the running of race number 10 an information was lodged instigating a protest against horse number 11 (Ernestlordrutherford) placed first by the Judge. The Stipendiary Stewards alleged a breach of rule 869 (7) (b). The basis of the protest was that during the run home Ernestlordrutherford had moved in and had run over or struck each of the markers for approximately 50 metres.
--At the outset of the hearing Mr Escott showed the video evidence and the Committee was asked to note by the Stipendiary Stewards of the movement in of Ernestlordrutherford and that it struck each of the pylons over a distance of approximately 50 metres.
----On completion of the video evidence Mr McPherson advised that he accepted that a breach had occurred and that Ernestlordrutherford would be disqualified.
----The Committee, accordingly, upholds the protest and horse number 11, placed first by the Judge, is disqualified from the race. The amended placings now read 3, 6, 1, 12, 13.
