Advised half blinds but wearing pacifier”. Mr Tapper was the trainer of IN DEFAULT in Race 10

Mr Tapper had signed the Statement by the Defendant on the information form indicating that the breach was admitted and that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.

Rule 865 provides as follows:

--

(2)     A horse may race with different gear from its last start when the owner, trainer or person in control of the horse has notified the change in the manner prescribed in the Approved Gear Regulations. Any such change is to be advised not later than the official time for notification of drivers as specified in the Notification of Drivers Regulations.

Mr Renault stated that it was observed in the birdcage prior to Race 8 that IN DEFAULT, trained by Mr Tapper, was wearing a pacifier and not the half blinds which had been notified.

Mr Renault recommended a fine of $50.

--

Mr Tapper was fined the sum of $50.
