Decision:

Following Race 4 an information was filed pursuant to Rule 871(1)(d). The informant, Mr A. Coles, alleged that near the 500 metres Ms Wenn  rider of SUMMERSKI, allowed her mount to shift out when not clear of EEZEJET (R. Norvall), causing that horse to be sharply checked.

Following Race 4 an information was filed pursuant to Rule 871(1)(d). The informant, Mr A. Coles, alleged that near the 500 metres Ms Wenn  rider of SUMMERSKI, allowed her mount to shift out when not clear of EEZEJET (R. Norvall), causing that horse to be sharply checked.

Ms Wenn admitted the breach and was present at the hearing.

Mr Williamson, Stipendiary Steward, demonstrated the video films from the 500 metre mark, which showed Ms Wenn angle her mount outwards when not sufficiently clear resulting in a sharp check to EEZEJET. He highlighted the hind quarters had made contact.

Ms Wenn said that she was racing in tight quarters and in her opinion the movement was minimal.

Penalty Submissions

Mr Coles said Ms Wenn had 2 previous breaches of this rule in the last year, both receiving 4 day suspensions. He said the offending was at the lower end of the scale and a minimum suspension would be appropriate.

Ms Wenn said she had riding commitments at Tauranga on July 15 and would like the suspension to start after that race day. She confirmed her riding commitments were in the North Island.

Penalty

The Committee carefully considered all submissions and before imposing an appropriate penalty took into account the following:

--

1: The guilty plea.
2: Ms Wenn’s good record.
3: Level of carelessness, lower range.
4: The interference suffered by Mr Norvall.

--

Accordingly we impose a suspension to start after racing on 15th July and to conclude after racing on the 23rd July 2009 (4 days).

--
