Decision:

Following Race 2 an Information was filed pursuant to rule 638 (1) (d).  The Informant, Mr Coles, alleged that 100 metres after the start Mr C Lammas, riding SIRRIO allowed his mount to shift in when not clear of HOOF IT (S Spratt) and RED GENERAL (N Collett).  As a result both horses were tightened and checked.

Following Race 2 an Information was filed pursuant to rule 638 (1) (d).  The Informant, Mr Coles, alleged that 100 metres after the start Mr C Lammas, riding SIRRIO allowed his mount to shift in when not clear of HOOF IT (S Spratt) and RED GENERAL (N Collett).  As a result both horses were tightened and checked.

Mr Lamas pleaded guilty to the charge.

Mr Williamson demonstrated the video films which clearly showed at a point soon after the start, Mr Lammas riding SIRRIO, allow his mount to move in when only ¾ length clear of HOOF IT and RED GENERAL on his inside.  Both these runners were badly tightened as a result.  It was evident on the films the runners in front and beside Lammas did not contribute to the interference.

Mr Lammas, while admitting the charge, said his mount was a first starter and wanted to follow the runners on his inside towards the running rail.

PENALTY SUBMISSIONS

Mr Coles said Mr Lammas had a good record with 2 previous charges this year.  He asked the Committee to take into account Mr Lammas’ mount was a first starter and somewhat green.  He submitted a suspension was appropriate but should be at the lower end.

Mr Lammas said he did not have any commitments after 26 October 2009.

PENALTY

--

The Committee carefully considered all the evidence presented before imposing a fair and appropriate penalty.  Mitigating factors were Mr Lammas’ good record, his guilty plea and that this was a 2 year old race with a lot of first starters.

--

Accordingly we impose a suspension on Mr Lammas from riding in races which starts after racing on 26 October 09 and concludes after racing on 31 October 2009 (4 days).
