Decision:

Following the running of race 6, the Pioneer/Pilet Contracting 1200, Mr Bosson was charged with careless riding under rule 871 (1) (d).  The information alleged that “O Bosson angled his mount (SKI) inward near the 150m and dictated QUALITY SEVILLE (K Smith) inward onto SUPERION (M Tanaka) who was checked”.



Following the running of race 6, the Pioneer/Pilet Contracting 1200, Mr Bosson was charged with careless riding under rule 871 (1) (d).  The information alleged that “O Bosson angled his mount (SKI) inward near the 150m and dictated QUALITY SEVILLE (K Smith) inward onto SUPERION (M Tanaka) who was checked”.

Rule 871(1)(d)) states “Every rider commits a breach of these rules who in the opinion of the Judicial Committee is guilty of riding that was ......careless”.

Mr Bosson indicated on the information he admitted this breach of the rules.  As the breach of the rule was admitted the charge was proven.

Mr Goodwin showed the videos of the incident which showed Mr Bosson looking for a run and allowing his mount to shift inwards near the 150 metre mark causing “Quality Seville” (K Smith) to also move inward and cause a check to “Superion” (M Tanaka).  He said that Mr Smith’s mount had been dictated inwards but had not helped itself by over-reacting and as a result the incident  looked worse than it actually was.  Nevertheless Mr Bosson had shifted in when not sufficiently clear.

Penalty Submission

In relation to penalty Mr Goodwin said that Mr Bosson was last charged under this rule on 27 June 2009 at Hawkes Bay and had received a 4 day suspension. He said he was a leading rider who rode throughout the country whose riding record was very good.  He put the interference in the low-mid range and thought a suspension of 4 days was an appropriate penalty.

Mr Bosson stated that he wished to a seek a 7 day deferral of any suspension to allow him to ride at the Hawkes Bay meeting on 19 September 2009

Decision

--

In coming to a decision on penalty the Committee considered all the submissions put before it.

--

We have taken into account Mr Bosson’s admittance of the breach, his good riding record and we agree with the Stipendiary Steward’s view that the offending is at the low-mid range.  We have also noted  Mr Bosson’s request for a 7 day deferral of any suspension.

--

Mr Bosson is suspended from the conclusion of racing on Saturday 19 September until the conclusion of racing on Friday 25 September 2009.
