DECISION AND REASONS: Following the running of Race 9, PGG Wrightson Mobile Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Open Driver, Mr M P Edmonds, alleging that Mr Edmonds, as the driver of JUDYS A FLYIN in the race, used his whip excessively in the run home.

Mr Edmonds had signed the Statement of Defendant on the information form indicating that he admitted the breach of the Rule and, further, that he did not wish to be present at the hearing of the information.

The charge was found to be proved.

Mr McIntyre showed a video replay of the final stages of the race. Mr McIntyre alleged that Mr Edmonds used his whip 35 times on JUDYS A FLYIN in the run home. This was borne out by the video replay. Mr McIntyre stated that this would be viewed ?in the public arena? and was unacceptable. The Committee noted that JUDYS A FLYIN finished in 4th placing in the race. Mr McIntyre informed the Committee that Mr Edmonds had not previously breached this particular Rule. He recommended a fine of $200.00.

Mr Edmonds was fined the sum of $200.00 based on his admission of the breach, his previous good record and the recommendation of Mr McIntyre.

The Committee, in addition to fining Mr Edmonds, wishes to censure Mr Edmonds for his use of the whip on this occasion. To strike a horse in excess of 30 times in the run home, and with no discernible pauses or alternative actions, is well outside the guidelines laid down for use of the whip, of which Mr Edmonds would be well aware, and the Committee agrees with Mr McIntyre that it is unacceptable.
