An information was lodged by Stipendiary Steward Mr TW Taumanu against Mr A James the Driver of Mantovani alleging a breach of the above Rules in that horseman A James failed to obey the Starter's instructions and/or permitted Mantovani to start from its incorrect barrier position.

Mr James admitted the breach and was present at the Hearing.

Stipendiary Steward Mr JM Muirhead as witness demonstrated the start of the race by use of the video film. There were two horses on the front line and Mr James' horse was in the unruly one position. Mr Muirhead showed that Mr James had lined up outside the two horses on the front line and only about another sulky width outside the second of those two horses.

Mr Muirhead referred to the definition of Unruly Position in the Race Starting Procedures Regulations and showed that Mr James was clearly in the wrong position. Mr James' horse broke at the start and because it was in the incorrect barrier position it contributed to (but was not the sole cause of) other horses breaking at the start.

Mr Muirhead also stated that the Starter had told Mr James to start wide on the front line.

Mr James acknowledged that the Starter had spoken to him and had told him to start wide out from the other two horses on the front line and in looking at the film he thought he was four or five out from the inside horse. Mr James has however acknowledged that he was in the incorrect barrier position.

In regards to penalty Mr Taumanu sought a suspension of Mr James' Horseman's Licence for a period of six weeks and Mr James on his part thought that that was excessive.

In considering all matters put before me it is clear that Mr James was certainly in an incorrect barrier position at the start. He was not in the Unruly Position.

I accordingly order that Mr James' Horseman's Licence be suspended for a period of six weeks up to and including the 12th of July 2007.
