--6 MARCH 2010
--Following Race 7 a protest was lodged pursuant to Rule 642(1). The Informant, Mr Peard, alleged that EILEEN DUBH or its rider, placed second by the Judge, caused interference to NO FEAR placed third by the Judge. This interference was alleged to have occurred in the final straight. The margin between second and third was a nose.

--Following Race 7 a protest was lodged pursuant to Rule 642(1). The Informant, Mr Peard, alleged that EILEEN DUBH or its rider, placed second by the Judge, caused interference to NO FEAR placed third by the Judge. This interference was alleged to have occurred in the final straight. The margin between second and third was a nose.
--All connections were informed of the protest.

Mr A Peard, rider of NO FEAR, demonstrated the video films and showed, at a point approaching the 300 metres, where EILEEN DUBH came out and took his rightful line of running. He said this caused him to lose momentum and change ground to his inside. He told the Committee this cost him ½ a length.
--Mr Wallace confirmed Mr Peard’s evidence and Mr Petersen had no further comment.
--Mr J Riddell, rider of EILEEN DUBH, said that in his opinion NO FEAR was never going to get past him. He said Mr Peard was not entitled to come out for the run as there was not enough room for him to do so. He said that after the incident NO FEAR had at least a furlong to get past him.
--Mr Finnigan, trainer of EILEEN DUBH, said he saw no evidence of NO FEAR being inconvenienced.
--Mr C George, when asked for his assessment of the incident, said it was clear that EILEEN DUBH shifted out when not clear. He said NO FEAR, after having to change ground, finished strongly in the run to the post. He had no doubt if interference had not occurred NO FEAR would have beaten EILEEN DUBH.
--DECISION
--The Committee carefully considered all the evidence and reviewed the video films. We are clearly satisfied that NO FEAR would have beaten EILEEN DUBH if interference had not occurred.
--Key elements in the decision are the ½ length suffered by NO FEAR when EILEEN DUBH came out into its line when insufficiently clear. The films clearly showed the strong manner in which NO FEAR finished the race to get within a nose at the Post.
--Because of the above factors the Committee upholds the protest and the placings shall now be:
--1st STAR OF KINGS (No 4)
2nd NO FEAR (No 3)
3rd EILEEN DUBH (No 1)
4th THE CRUNCHER (No 6)
5th FAZZLE (No 2)
