Following Race 10 an Information was filed pursuant to Rule 871 (1) (d) when it was alleged by the Informant Mr Coles that Mr Saad, rider of RIGHTEOUS LASS, allowed his mount to shift outwards near the 400 metre mark when not sufficiently clear

DECISION & REASON :
--Following Race 10 an Information was filed pursuant to Rule 871 (1) (d) when it was alleged by the Informant Mr Coles that Mr Saad, rider of RIGHTEOUS LASS, allowed his mount to shift outwards near the 400 metre mark when not sufficiently clear of McCAHON, ridden by Mr G McKeon, who had to be checked.
--Mr Saad admitted the breach and was represented by trainer Mr P Jenkins.
--Mr Oatham demonstrated the video films and showed that approaching the 400 metre mark, Mr Saad angled his mount out for a run and in doing so moved into the line of McCAHON (ridden by Mr G McKeon). Mr McKeon received a sharp check as a result. Mr Saad was not the required distance clear of McCAHON when he took his line.
--Mr Jenkins, on behalf of Mr Saad, said he had received some interference himself earlier on in the race and from then on was having some difficulty with his mount. He asked the Committee to take into account Mr Saad's guilty plea.
--Mr Coles, when asked for submissions on penalty, said that Mr Saad had been riding in New Zealand for three years with only one charge, being in 2 December 2006. He asked the Committee to consider Mr Saad's guilty plea and his good record but added that Mr Saad had angled out without regard to Mr McKeon on his outside. He believed a suspension was appropriate.
--DECISION
--The Committee considered all submissions and took into account Mr Saad's good record and his guilty plea. However, Mr Saad was guilty of angling out when insufficiently clear in this instance and believe a suspension was the correct penalty.
--Accordingly we suspend Mr Saad from after the conclusion of racing on the 18th April up to and including the 26th April 2007 (3 days).
