Following the running of Race 4 an information was laid by Stipendiary Steward Mr N. G. McIntyre against Mr C. J. De Fillipi, driver of "So and So" (2), alleging a breach of Rule 869(3)(b).

DECISION AND REASONS:
--Following the running of Race 4 an information was laid by Stipendiary Steward Mr N. G. McIntyre against Mr C. J. De Fillipi, driver of "So and So" (2), alleging a breach of Rule 869(3)(b). The charge was that Mr De Fillipi drove carelessly with about 600m to run when shifting outwards with resultant interference to "Jazz Legend" (7) driven by Mr R. T. May.
--Mr De Fillipi indicated on the information that he pleaded guilty to this charge and that he did not wish to attend this hearing. The evidence relating to this matter had been gone into in full during the hearing of the protest into "So and So's" 2nd placing. "So and So" was subsequently relegated to 6th place.
--Penalty: In relation to penalty the Mr McIntyre advised that Mr De Fillipi had been fined $300-00 for a similar breach earlier this month. A fine of $300-00 was recommended in this case also.
--I take into account that Mr De Fillipi accepted that he had caused interference to "Jazz Legend" and that he pleaded guilty to this charge. A fine of $300-00 is appropriate and Mr De Fillipi will be fined this amount.
