Decision:

The Information alleges that C Driver the horseman of “Nightime Magic” drove carelessly when he shifted his horse inwards after the start causing a check to “Inaugural Man” which broke.



The Information alleges that C Driver the horseman of “Nightime Magic” drove carelessly when he shifted his horse inwards after the start causing a check to “Inaugural Man” which broke.

Mr Driver did admit the breach and was represented by Mr P Butcher.

After viewing video footage of the alleged incident Mr Butcher felt that had a more senior horseman been inside Mr Driver he or she would have taken evasive action and the check would have not occurred.

The Chairman pointed out to Mr Butcher it was a “Junior Horseman” event and the check was caused by Mr Driver.  The onus was on him not the person being checked.

The Stipendiary Stewards asked the Chairman when he was arriving at a penalty to take into account Mr Driver’s youth and his co-operation with the Authorities.

Mr Butcher on behalf of Mr Driver felt a minimum fine would be appropriate.

Prior to arriving at a penalty the Chairman took into account submissions from both parties and also that it was Mr Driver’s first offence.  However these factors were outweighed by the fact Mr Driver’s carelessness had resulted in a change of placings and the horse “Inaugural Man” may have even gained a higher placing than that he was promoted to without the interference form Mr Driver, therefore a monetary penalty was appropriate.

Accordingly Mr Driver was fined $250.
