DECISION AND REASON:

Following Race 6 an information instigating a protest under Rule 876(1) was lodged by Stipendiary Steward Mr A Coles against SEVEN HILLS placed first (Trainer K Rae) alleging interference to AMAZING ME (Trainer B Gillovic) placed second, in the final straight. Mr Rogerson represented the owner of AMAZING ME.

Mr Oatham, Stipendiary Steward, demonstrated on the head-on and side-on films the passage of SEVEN HILLS into a gap that he was not entitled to and the effect of two contacts on AMAZING ME. AMAZING ME made up ground to be half a length from SEVEN HILLS at the line. Mr Oatham stated that SEVEN HILLS forced a passage when not entitled to.

Mr Bosson, rider of AMAZING ME, when questioned by Mr Coles said that he lost two lengths and recovered to finish within half a length of SEVEN HILLS.

Mr Rae stated that SEVEN HILLS took the gap and was eased down at the post and could have won by a greater margin.

Mr Rogerson said that AMAZING ME was entitled to its line and contact was made by SEVEN HILLS when it was not entitled to take the gap.

The Committee decided that SEVEN HILLS interfered with the chances of AMAZING ME and stopped the progress of AMAZING ME by making contact on two occasions. The Committee exercised a discretion to place SEVEN HILLS behind AMAZING ME, taking into account the severe contact to AMAZING ME by SEVEN HILLS when SEVEN HILLS took a gap it was not entitled to and checked AMAZING ME up to two lengths. AMAZING ME finished on to within half a length of SEVEN HILLS.
