Mr Bates you’ve admitted a breach of rule 871(1)(d) in race 2 in that you angled out for a run some 200 metres from the finish. In so doing, you came into contact with OF GOOD HOPE and this resulted in interference to YOURANGMAAM.

Mr Bates you say you gave the horse a flick with the whip and a jag in the mouth when angling for a run and it over-reacted.

The Committee’s observation is that you angled for a run and, while so doing, gave a sharp yank on the reins with the result that your mount, EL BEE DEE moved sideways and came into contact with OF GOOD HOPE.

Mr Ching has described the breach as mid range and we see no reason to disagree. He has asked for a suspension or perhaps a fine and a suspension. You ask for a substantial fine or 1 day’s suspension plus a fine.

Taking into account your admission of the breach and relatively good record of 2 breaches of this rule this calendar year, when we consider the fact that you are a regular rider, we believe the minimum period of suspension required is 2 days. You have asked that the commencement of the suspension be after the meeting at Riverton this Friday where you believe you have a number of rides. Mr Ching has indicated that he has no objection to this. We suspend you from riding at the conclusion of racing on Friday 26 October up to and including Tuesday 6 November. This is 2 South Island days. We also fine you the sum of $400. We emphasise that had there not been the mitigating factors, we would not have considered anything less than a 3 day suspension as being appropriate.
