Following race 5 an information was filed pursuant to Rule 871(1)(d). The informant, Mr Oatham, alleged that Miss R Smyth permitted her mount CHEEKY RED to shift inwards passing the 800 metres when insufficiently clear of CHIEF TOBIAS (A Webb) who was forced inwards crowding O’OH (C Grylls) who was checked.

Following race 5 an information was filed pursuant to Rule 871(1)(d). The informant, Mr Oatham, alleged that Miss R Smyth permitted her mount CHEEKY RED to shift inwards passing the 800 metres when insufficiently clear of CHIEF TOBIAS (A Webb) who was forced inwards crowding O’OH (C Grylls) who was checked.
--Miss Smyth pleaded guilty to the charge. Prior to the hearing it was confirmed that as this was a guilty plea and Miss Smyth’s employer, Mr S McKee, having to leave the course, Miss Smyth would appear on her own. Mr McKee and Miss Smyth both agreed with this. The Stipendiary Stewards had shown Mr McKee the film and apprised him of the charge.
--Mr A Coles demonstrated the video films which clearly showed that shortly after the 800 metres Miss Smyth move in from a three wide position when not the required distance clear of CHIEF TOBIAS. This caused CHIEF TOBIAS to be forced inwards onto O’OH who had to be checked and losing 1 – 1 ½ lengths.
--PENALTY SUBMISSIONS:
Mr Oatham said Miss Smyth had been riding for six months and this was her first charge in 72 rides. He submitted this offence was in the lower to mid-range.
Miss Smyth had nothing to add other than a confirmed ride on Saturday the 28th.
--PENALTY:
The Committee considered all submissions and before imposing penalty took into account the following:
1. Miss Smyth’s excellent record.
2. Her guilty plea.
3. Her inexperience.
However, these factors had to be balanced against the interference suffered by two runners.
Accordingly we believe a suspension is appropriate and we impose a suspension on Miss Smyth for riding in races which begins after racing on the 28 March and concluding after racing on 4 April 2009 (4 days).
