Information No. 68030 was filed by Stipendiary Steward, Mr S P Renault, against Licensed Public Trainer, Mr F R Bebbington alleging that Mr Bebbington, as the trainer of AVALON PETITE, a runner in Race 6, Bill Lilley & Dave Peters Memorial Mobile (PBD) Trot, “failed to present this horse to race with good quality shoes which had to be attended to by the farrier at the start causing this race to run late”.

Information No. 68030 was filed by Stipendiary Steward, Mr S P Renault, against Licensed Public Trainer, Mr F R Bebbington alleging that Mr Bebbington, as the trainer of AVALON PETITE, a runner in Race 6, Bill Lilley & Dave Peters Memorial Mobile (PBD) Trot, “failed to present this horse to race with good quality shoes which had to be attended to by the farrier at the start causing this race to run late”.

Mr Bebbington had signed the Statement by the Defendant information form indicating, firstly that the breach was admitted and, secondly, that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.

Rule 864 provides as follows:
(2) Every horseman, owner, trainer and assistant thereof of a horse shall with regard to that horse ensure that:-
(b) any gear, appliance or device used or to be used in a race is of good quality and is in good order and condition.

Mr Renault informed the Committee that AVALON PETITE had to be attended at the starting point prior to Race 6 and it was necessary for the horse’s front shoes to be replaced by the Club’s farrier. The start of the Race was held up and eventually started late. The shoes were not in good order and condition, Mr Renault said. The situation was drawn the attention of the starter by the horse’s driver (R T May) and the farrier was called.

Mr Bebbington had not breached the Rule previously. Mr Renault recommended a fine of $100.

The Committee took into account Mr Bebbington’s good record and his admission of the breach.

Mr Bebbington was fined the sum of $100.
