Following the running of Race 4, the Metalcraft Roofing Handicap Trot, an Information was laid by Chief Stipendiary Steward Mr N. R. Escott alleging a breach of Rule 869(3)(b) (careless driving) by Mr R. P. Nyhan

DECISION AND REASONS:
--Following the running of Race 4, the Metalcraft Roofing Handicap Trot, an Information was laid by Chief Stipendiary Steward Mr N. R. Escott alleging a breach of Rule 869(3)(b) (careless driving) by Mr R. P. Nyhan the driver of "Billy Boy" (7). There had previously been a protest hearing in relation to the 5th placing of "Billy Boy" after which that horse was relegated to 7th place.
--Mr Nyhan admitted this breach of the Rules. The careless driving consisted of Mr Nyhan shifting down into the trail after about 350 metres when not sufficiently clear resulting in Conagher breaking. The video coverage of this incident had been viewed at the protest hearing.
--Penalty:
--In relation to penalty Mr Escott advised that Mr Nyhan had a conviction under Rule 869(4) almost a year ago. Mr Escott also said that it should be taken into account that Mr Nyhan had pleaded guilty to this charge, and that he had lost about $300-00 because of the relegation of his horse. A fine of $200-00 was recommended.
--Mr Nyhan had no submissions to make on penalty.
--After hearing these submissions we were satisfied that in all the circumstances a fine of $200-00 was appropriate, and Mr Nyhan was fined this amount.
