Decision:

Following Race 6 an information was filed pursuant to Rule 871(1)(d). The informant, Mr Coles, alleged that Mr Sweeney, rider of FYFETHEKNIFE, permitted his mount to shift in near the 150 metres when not sufficiently clear of KEEPAFLYIN (D Johnson) who was checked.



Following Race 6 an information was filed pursuant to Rule 871(1)(d). The informant, Mr Coles, alleged that Mr Sweeney, rider of FYFETHEKNIFE, permitted his mount to shift in near the 150 metres when not sufficiently clear of KEEPAFLYIN (D Johnson) who was checked.

Mr Sweeney pleaded guilty to the charge.

Mr Williamson demonstrated the videos films and showed where at the 150 metres , Mr Sweeney riding FYFETHEKNIFE moved in and took the line of KEEPAFLYIN when only a bare 1 length clear of that runner. This caused Miss Johnson to take a hold of her mount with the resultant check.

Mr Coles submitted that Mr Sweeney had a very good record with only 1 suspension this year and this offence warranted a 4 to 5 day suspension.

Mr Sweeney said he had a confirmed ride in the Melbourne Cup and would like the penalty to start immediately after racing on November 4th.

Penalty

The Committee carefully considered all submissions and before imposing a penalty took into account:

--

1: Mr Sweeney’s guilty plea.

--

2: His very good record.

--

3: Degree of carelessness.

--

4: The interference suffered by Miss Johnson.

--

Accordingly the committee imposed a suspension to be served by Mr Sweeney starting after racing on November 4 and to conclude after racing on November 11 2008 (5 days).
